  • business information, including company name, company number, trading history, sector, turnover, ownership and management details;
  • financial information, including bank details, accounts, cash-flow information, existing borrowing, liabilities, income and expenditure;
  • information about directors, shareholders, beneficial owners, partners, guarantors and other people connected with the business;

We may collect personal information directly from you, from someone acting on your behalf, from your business, from introducers or partners, from finance providers, from credit reference and fraud prevention agencies, from identity-verification providers, from Companies House and other public sources, and through our website and cookies.

Where you provide personal information about another individual, you should make sure you are authorised to do so and, where appropriate, that the individual has been given access to this Privacy Policy.

5. Why we use personal information

We may use personal information to:

  • respond to enquiries and communicate with you;
  • understand your business-finance requirements and progress an application;
  • identify finance providers or products that may be relevant to your circumstances;
  • submit information to finance providers and support the application process;
  • assess or help assess eligibility, affordability and creditworthiness;
  • verify identity and carry out anti-money laundering, sanctions, fraud-prevention and other compliance checks;
  • manage our relationship with you, including complaints and customer support;
  • keep records required for legal, regulatory, audit and risk-management purposes;
  • prevent misuse of our website and protect our systems and users;
  • analyse and improve our website, services and customer journey;
  • send service communications and, where permitted, marketing communications;
  • establish, exercise or defend legal claims and comply with lawful requests from regulators or authorities.

6. Our lawful bases

Depending on the processing activity, we may rely on one or more of the following lawful bases under UK data protection law:

  • taking steps at your request before entering into a contract and performing a contract;
  • compliance with legal and regulatory obligations;
  • our legitimate interests or those of a third party, where those interests are not overridden by your rights and interests;
  • your consent, where consent is required. Where special category information is processed, we will only do so where an additional lawful condition applies. Where criminal-offence data is processed, we will only do so where permitted by law and with appropriate safeguards.

7. Credit reference and fraud prevention checks

We and/or finance providers may search credit reference agencies and fraud prevention agencies in connection with an application. These organisations may provide information about you, your business and people connected with the business. Searches may leave a record on a credit file, and some search types may be visible to other organisations.

Information may also be used to verify identity, assess creditworthiness, prevent fraud and money laundering, manage accounts and recover debts. Finance providers will have their own privacy notices explaining their use of credit-reference and fraud-prevention information.

8. Who we may share information with

Where necessary and lawful, we may share personal information with:

  • lenders and other finance providers on our panel;
  • credit reference agencies and fraud prevention agencies;
  • identity-verification, anti-money laundering and sanctions-screening providers;
  • introducers and business partners where relevant to your enquiry;
  • IT, hosting, CRM, communications, analytics and other service providers;
  • professional advisers, auditors, insurers and compliance providers;
  • regulators, law-enforcement bodies, courts, government bodies and other authorities where required or permitted by law;
  • a buyer, investor or other party involved in a proposed sale, merger, restructuring or transfer of all or part of our business, subject to appropriate safeguards. We only share information that is reasonably necessary for the relevant purpose. A finance provider that receives your information will normally process it under its own privacy notice and may act as a separate data controller.

9. Commission and lender relationships

We work with a panel of finance providers and may receive commission or other remuneration from a lender for introducing business. Information about our remuneration is separate from our data-protection obligations, but we may process information about applications, outcomes and completed finance in order to administer and reconcile commission and maintain our commercial records.

10. Automated processing and profiling

We and/or finance providers may use automated tools, scoring or profiling to help assess eligibility, creditworthiness, fraud risk, affordability or which finance options may be relevant. Where a decision is made solely by automated means and produces legal or similarly significant effects, the rights and safeguards required by data protection law will apply.

11. Marketing

Where permitted by law, we may contact you about MoneyRepublic products, services or related business-finance opportunities. We may rely on consent or legitimate interests depending on the circumstances and communication channel.

You can opt out of marketing at any time by using the unsubscribe method in the communication or by contacting support@moneyrepublic.co.uk. Opting out of marketing will not stop service or regulatory communications about an existing enquiry or application.

12. Cookies and website analytics

We use cookies and similar technologies for purposes such as operating the website, security, remembering preferences, analytics and, where you consent, advertising or marketing measurement. Further information is provided in our Cookie Policy and through the cookie-preference controls on our website.

13. International transfers

Some service providers may process personal information outside the United Kingdom. Where we make a restricted international transfer, we will use an appropriate lawful transfer mechanism and any additional safeguards required by UK data protection law.

14. How long we keep information

We keep personal information only for as long as reasonably necessary for the purposes for which it was collected, including to meet legal, regulatory, accounting, audit, fraud-prevention and dispute-resolution requirements. Retention periods vary depending on the type of information, the outcome of an application and our legal or regulatory obligations.

When information is no longer required, we will delete it, anonymise it or securely archive it in accordance with our retention procedures.

15. Security

We use appropriate technical and organisational measures designed to protect personal information against accidental or unlawful loss, alteration, disclosure, misuse or unauthorised access. Access is restricted to people and service providers who need the information for legitimate purposes and who are subject to appropriate confidentiality and security obligations.

16. Your data-protection rights

Depending on the circumstances, you may have rights to:

  • ask for access to your personal information;
  • ask us to correct inaccurate or incomplete information;
  • ask us to erase information in certain circumstances;
  • ask us to restrict processing in certain circumstances;
  • object to processing based on legitimate interests;
  • object to direct marketing at any time;
  • receive certain information in a portable format;
  • withdraw consent where processing is based on consent;
  • request safeguards relating to certain solely automated decisions. To exercise a right, contact support@moneyrepublic.co.uk. We may need to verify your identity before acting on a request.

17. Complaints about data protection

If you have concerns about how we use personal information, please contact us first at support@moneyrepublic.co.uk so we can try to resolve them.

You also have the right to complain to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection. The ICO can be contacted through ico.org.uk.
